Our General Terms and Conditions, together with the agreed travel
program and general information, constitute your travel contract
with WT Safaris. The specific characteristics of adventure and
experiential travel in East Africa are taken into account.

Conclusion of the Safari Contract
By registering, the customer makes a binding offer to WT Safaris,
as the safari operator, to conclude a safari contract. Registration
can be made in writing, verbally or by telephone.
The registration is made by the person registering also on behalf
of all participants listed in the registration. The contract is
concluded upon acceptance by WT Safaris as the safari operator.
WT Safaris will issue a booking confirmation to the customer after
receiving the deposit.
Upon conclusion of the contract and issuance of the invoice, a
deposit of 50% of the safari price is due. The deposit will be
credited towards the safari price.
The remaining safari price is due four weeks before departure.
For short-notice bookings made less than four weeks before the
start of the safari, the entire safari price is due immediately.
The scope of all services is exclusively defined by the service
description provided by WT Safaris, together with the corresponding
safari confirmation and taking into account the information in the
currently valid brochure.
Any supplementary agreements must be in writing and expressly
confirmed by WT Safaris.

Changes to Services and Prices
Deviations of individual safari services from the agreed content
of the safari contract that become necessary after conclusion of
the contract and that are not brought about by WT Safaris in bad
faith are permitted, provided they are not significant and do not
affect the overall character of the booked safari.
This applies in particular where official measures or weather
conditions in the countries visited make changes to the safari
itinerary necessary.
In the event of price increases by service providers after
conclusion of the contract, WT Safaris is entitled to pass these
increases on to the traveler. The safari operator must inform the
safari participant of such price changes without delay.
If the price increase exceeds ten percent, the participant may
withdraw from the travel contract by written declaration within
two weeks of notification.

Cancellation by Customers, Rebookings, No-Shows and Early Termination
The traveler may cancel the safari at any time. The date on which
WT Safaris receives the written cancellation notice is decisive.
A rebooking is considered a cancellation followed by a new booking.
The following flat-rate cancellation fees apply:
- Up to 45 days before the start of the safari: 10% of the safari price.
- From 44 to 30 days before safari departure: 40% of the safari price.
- From 29 to 8 days before safari departure: 70% of the safari price.
- From 7 days before safari departure: 100% of the safari price.
- Failure to appear for safari departure is treated as cancellation on the departure day, and 100% of the safari price is due.
Note regarding round trips:
A 50% deposit is due immediately upon booking confirmation.
No refunds are available after booking confirmation and payment
of the deposit.
If the canceling traveler provides a replacement traveler, no
cancellation fees will be charged.
If the traveler terminates the safari prematurely, no refund will
be issued for unused services. The traveler is responsible for
their onward or return travel.
If the traveler does not use individual safari services due to
early return or other compelling reasons, WT Safaris will endeavor
to obtain a refund of saved expenses from the service providers.
This obligation does not apply where the services concerned are
entirely insignificant or where statutory or official regulations
prevent reimbursement.

Cancellation by WT Safaris
WT Safaris may cancel the safari contract up to three weeks before
the start of the safari if the minimum number of participants
stated in the safari brochure is not reached.
In this case, the amount paid will be refunded less a 10% processing
fee. No further claims exist.

Cancellation Due to Exceptional Circumstances
If the safari is significantly hindered, endangered or impaired
as a result of force majeure, including war, civil unrest, natural
disasters, epidemics or similar circumstances that were
unforeseeable when the contract was concluded, both the traveler
and WT Safaris may cancel the safari contract.
WT Safaris will refund the amount paid without delay, but may demand
reasonable compensation for services already rendered and services
still required to complete the safari.
If cancellation occurs after the safari has begun, WT Safaris is
obligated to take the necessary measures, particularly to transport
travelers back where this was contractually agreed.
Additional return transport costs will be borne proportionally by
both parties. The traveler will bear any other additional costs.
WT Safaris is liable, within the scope of the due diligence of a
prudent businessperson, for the conscientious preparation and
execution of the safari, the selection and supervision of service
providers, the accuracy of the service description and the proper
provision of contractually agreed safari services in accordance
with local and national customs.
WT Safaris is not liable for risks arising from the inherent nature
of an adventure safari. This risk is borne by the traveler.
Liability is excluded for accidents that may occur in aviation,
while using local land or water transport, or while using the
traveler’s own off-road vehicles.
This also applies to activities such as hiking, mountain climbing,
excursions and attacks by people or animals of any kind.
WT Safaris is not liable for disadvantages caused by defective
vehicles and resulting route changes, schedule changes, arbitrary
actions by local authorities, fuel or supply problems, or other
force majeure events beyond the control of WT Safaris.
WT Safaris accepts no liability for service disruptions connected
with third-party services that are merely brokered, such as
sightseeing tours or excursions, and identified as such in safari
descriptions.
Where transportation is provided through scheduled services and a
corresponding ticket is issued, WT Safaris acts only as an
intermediary. WT Safaris is therefore not liable for delays,
accidents, cancellations or resulting additional costs.
WT Safaris cannot be held liable for damage to or loss of personal
equipment, including photographic or filming equipment, caused by
theft or extreme conditions such as sand, dust, high humidity or
long journeys over difficult terrain.

Service Disruptions and Duty to Cooperate
The traveler is obligated to do everything reasonably possible to
help resolve service disruptions and minimize resulting damage.
In particular, the traveler must notify WT Safaris immediately of
any complaint. WT Safaris will, where possible, provide a remedy or
acknowledge claims for price reduction or compensation.
If the traveler fails to comply with these obligations, the
traveler is not entitled to a price reduction.
Claims for non-performance or improper performance of safari
services must be submitted in writing to WT Safaris within one
month after the contractually agreed end of the safari.
All claims arising from the safari travel contract expire six
months after the contractually agreed end of the safari. Claims
arising from tort, personal injury or death expire three years
after the end of the safari.
The assignment of any traveler claims, regardless of their legal
basis, to third parties, including spouses, is excluded. The
traveler is likewise prohibited from asserting such claims in
court in their own name.

Passport, Visa and Health Regulations
The traveler is responsible for complying with all passport, visa,
customs, currency and health regulations.
Any disadvantages arising from non-compliance with these regulations
are the responsibility of the traveler, even if official regulations
have changed after booking.
The invalidity of individual provisions of the safari travel
contract does not render the entire safari travel contract invalid.

Organizer and Jurisdiction
WT Safaris is the organizer. The place of jurisdiction for legal
action against WT Safaris is its registered office.
For legal action against the traveler, the place of jurisdiction
is the traveler’s place of residence.
Important Travel Insurance Recommendation
We strongly advise all safari participants to take out travel
cancellation insurance.
We also strongly recommend a comprehensive travel insurance package
with worldwide health insurance, including medical repatriation,
personal injury and medical care.
The policy should also include baggage, liability and accident
insurance.
